The Valencia Plaza digital newspaper has published an interview with our CEO, Miguel Ángel Molina, in which he addresses how litigation before the Tax Agency has grown in recent years as a consequence of the increase in tax pressure and the consequent increase in taxes, declarations, procedures, settlements and sanctions.
In this sense, Tomarial Abogados, Economistas y Consultores has a successful Tax Litigation area specialized in defending taxpayers from the sanctions of the Tax Agency. «During 2023 we managed a total of 70 files that were the subject of an appeal and/or claim before the Courts. The success rate of the procedures that were resolved in this past year amounted to approximately 75%," explained Molina.
Asked why more and more people are resorting to judicial channels for tax issues, the CEO of Tomarial pointed out that in addition to the increase in control actions, on many occasions the reasons for regularization are of an interpretative nature. "There is a margin for this and the Administration usually makes a favorable and" interested "interpretation of its collection interests to proceed to liquidate and/or sanction the taxpayer," he indicated.
