On December 2nd, the former Supreme Court judge and counsel of Tomarial, Javier Orduña, will give the lecture “Analysis of the proposed regulation of the rebus sic stantibus clause” at the Valencia Bar Association (ICAV). This clause and its impact on the regulation of contracts is highly topical due to its importance in situations of force majeure, such as the recent catastrophes caused by the DANA, which have impacted many commercial relationships.

La rebus sic stantibus It allows contracts to be adapted when extraordinary circumstances —such as a DANA— temporarily make it impossible to comply with the agreement. In unforeseeable situations, this clause guarantees a fair outcome for both parties, preserving contractual balance.

This meeting will be a unique opportunity to explore, alongside a leading expert, how this solution works.
