The Tomarial Abogados y Asesores Tributarios firm has organized the conference “The challenges of the company in 2020 in fiscal, labor and commercial matters” in the auditorium of BBVA in Valencia. Representatives of 70 companies have attended the call, in which the experts of the firm have made analysis of the regulatory developments that have brought the year that has just ended and of the main issues that will mark 2020 for the companies.

Antonio Ballester, director partner of Tomarial, has inaugurated the work day making a forecast next year with lights and shadows: “Lights, because national macroeconomic data clears the storm of a possible recession or economic breakdown. In 2020 we will grow a little less than in 2019 but we will grow and this is the positive. We continue to grow and the unemployment rate decreasing. Shadows, because companies still do not know the composition of the future Government and the economic program that underpins the pact between PSOE and Podemos incorporates a series of measures that will, for the most part, place a greater tax burden on companies and a decline in the flexibilization measures that were introduced in the last Labor Reform ”.

The partners and different experts of Tomarial have been reeling off by themes the great challenges that companies face in 2020 in tax, labor and commercial matters. Regarding the accounting and fiscal closing of this year 2019, it arrives in a context of great uncertainty about the formation of a new government and with the concern that the announcements of the creation of new taxes have generated in the business community: on

digital services, on financial transactions, to banking ... And also measures such as raising rates in personal income tax, changes in Corporate Tax or a new law on tax fraud repression measures. The tax changes planned for 2020 have been broken down by the professionals of Tomarial, who have also answered the questions of the attendees.

The work environment is also of great concern to companies, both for the changes introduced in this year (a la carte workday, registration of working hours, salary registration, equal pay for reasons of sex, etc.) and for the announcements of a possible labor counter-reform or a new Workers Statute. That is why we have deepened in the day on the challenges in labor matters faced by companies in the scenario of next year and their adaptation to regulatory requirements.

In legal and commercial matters, the year 2019 has evidenced, through jurisprudence and sentences condemning companies in the criminal field, the importance of implementing a compliance protocol for the prevention of criminal risks. New obligations regarding data protection and money laundering have also entered into force. The scenarios of separation of partners and mandatory dividend distributions (art. 348 bis Capital Companies Law) remain non-peaceful and imminent changes are announced. Finally, companies already have a legal framework to protect their business secrets. In short, a work day that has served the professionals of the companies as an update and training in the aspects that generate more interest in the fiscal, labor and commercial aspects.
